DUI Defense And The Preliminary Hearing — Why It’s Important
At a preliminary hearing, the prosecution must answer two questions:
- Was a crime committed?
- Is it more likely than not that the person arrested committed the alleged crime?
The preliminary hearing allows us to cross-examine the officer who arrested you and/or who conducted your field sobriety test. This type of questioning gives us the opportunity to expose inconsistencies and mistakes on the part of the police. If this happens, your case may be dismissed. At this hearing, we inspect evidence that the Commonwealth will use against you at trial. Sometimes, that evidence can be suppressed, which often results in a complete dismissal of charges. Other times, we may uncover evidence that will help us defend your case.
The Preliminary Hearing is a very important stage for DUI Defense. No one should represent themselves without a lawyer at this phase of their case.
